1. Introduction and legal operator
Nommad is a product and service offering of OneTap LLC. OneTap LLC is the legal entity providing and contracting for the Nommad service. References to "Nommad," "we," "us," or "our" in these Terms refer to OneTap LLC in connection with Nommad.
2. Acceptance of these Terms
By creating or managing an account, submitting content or a request, or otherwise using an authenticated Nommad service, you agree to these Terms and any supplemental terms that apply to your role. If you do not agree, do not create an account or use authenticated Nommad services. Viewing publicly available pages without an account does not by itself create an account relationship.
3. Eligibility and age
You must be at least 18 years old to create a Nommad account, manage a Vendor account, create or manage a Host & Organizer workspace or organization, or enter into a paid or vendor account arrangement. Public Nommad pages may be viewed without an account.
4. Authority for organizations and businesses
If you use Nommad for a company, organization, vendor, or other entity, you represent that you have authority to act for and, where applicable, bind that entity to these Terms.
5. What Nommad provides
Nommad provides public mobile-food discovery and authenticated Customer, Vendor, Host & Organizer, organization, and administrative tools. Features may include vendor profiles, menus, schedules, locations, events, Spots, requests, reviews, QR links, analytics, and operational tools. Nommad is a platform and is not the underlying food, beverage, catering, event, or vendor transaction.
6. Accounts and role-based access
Different account roles have different permissions. You must provide accurate account information, use only roles and workspaces you are authorized to access, and promptly update information that becomes inaccurate. Vendor Terms supplement these Terms for Vendor accounts.
7. Account and security responsibilities
You are responsible for safeguarding passwords, authentication devices, recovery credentials, and account sessions; restricting access to your account; and notifying support promptly of suspected unauthorized use. You may not share credentials or attempt to bypass authentication, authorization, moderation, or security controls.
8. Vendor-submitted information
Vendors are responsible for information and materials they submit, including business identity, contact details, service areas, locations, schedules, menus, prices, specials, photos, logos, FAQs, responses, and operational information. Submission does not mean that OneTap LLC has independently verified the information.
9. Public vendor information
Approved and visible Vendor information may be displayed publicly through discovery, profile, menu, event, Spot, location, TV, QR, and related Nommad experiences. Vendors should not submit private information in fields intended for public display.
10. Location, schedule, menu, and special accuracy
Mobile vendors may move, close, sell out, change schedules, change menus or prices, or become unavailable without notice. OneTap LLC does not guarantee the accuracy or current availability of a vendor location, status, menu, price, food item, dietary statement, allergen statement, special, or service time. Users should confirm time-sensitive or dietary information directly with the vendor.
11. Requests, bookings, and event inquiries
A customer or Host & Organizer request is an inquiry. It is not automatically a booking, quote, reservation, payment, contract with a vendor, proof of vendor availability, or guarantee of acceptance or attendance. The requester and vendor are responsible for separately agreeing to their commercial arrangement. OneTap LLC is not a party to that transaction merely because Nommad transmitted the request.
12. Reviews and other user content
Reviews, replies, messages, requests, event information, and other content must be truthful, lawful, relevant, and respectful. You may not submit content that is abusive, deceptive, defamatory, harassing, private, infringing, unsafe, or otherwise unlawful. Review eligibility and publication may be subject to Nommad rules and moderation.
13. Content ownership and license
You retain ownership of content you own. By submitting content, you grant OneTap LLC a non-exclusive, worldwide, royalty-free license, for as long as reasonably necessary to operate, improve, provide, and promote Nommad, to host, store, reproduce, format, display, distribute through Nommad, create necessary technical adaptations, and promote your Nommad listing or service presence. You represent that you have all rights and permissions needed to submit the content. Uploading a logo, menu, photograph, or other material does not transfer its ownership to OneTap LLC.
14. Moderation and removal
OneTap LLC may review, approve, reject, request changes to, limit, hide, or remove content or access when reasonably necessary to operate Nommad, enforce these Terms, address safety or legal concerns, protect users or third parties, or maintain service quality. Moderation is not a guarantee that all content is accurate, lawful, or suitable.
15. Acceptable use
You may not use Nommad to break the law; infringe rights; impersonate another person or entity; scrape or expose private data; send spam; upload malicious code; interfere with service operation; probe or bypass security; manipulate reviews, scans, analytics, or availability; or use another account, vendor, organization, or record without authorization.
16. Intellectual property
Nommad software, design, branding, documentation, and platform materials are owned by OneTap LLC or its licensors and are protected by applicable intellectual-property laws. Except for the limited rights needed to use Nommad under these Terms, no rights are transferred to you.
17. TAP, QR, and other integrations
Nommad may integrate with TAP Connected Sites, QR, scan, mapping, analytics, authentication, email, monitoring, and related services. Availability and functionality may depend on configuration and third-party services. Provider credentials and security material remain private.
18. Third-party services and external links
Third-party sites, maps, embedded services, and integrations are governed by their own terms and privacy practices. OneTap LLC does not control and is not responsible for third-party content, availability, security, or performance. A link or integration does not imply endorsement.
19. Paid services and billing
Paid or Vendor services may include setup and monthly service fees disclosed separately. Setup fees are generally non-refundable once setup or onboarding work begins. Monthly service fees are non-refundable once the applicable monthly service period begins. An authorized Nommad administrator may record billing eligibility through a manual or offline process; that status does not mean Nommad processed an online payment. Pricing may change prospectively with reasonable notice. OneTap LLC may suspend or limit paid or Vendor functionality for overdue amounts.
20. Cancellation and reactivation
Vendors may cancel at any time. Cancellation prevents future monthly service periods from being charged after the current period ends. If cancellation occurs during a monthly service period, the full amount for that month remains due and there is no prorated refund or partial-month credit. A reactivation fee may apply after cancellation or inactivity; any applicable fee will be disclosed before reactivation.
21. Suspension and termination
OneTap LLC may suspend, limit, or terminate accounts, content, listings, paid features, or access for nonpayment, misuse, security risk, legal requirements, safety concerns, repeated policy violations, infringement, fraud, abuse, or material breach. You may stop using Nommad at any time, subject to amounts already due and terms that reasonably survive termination.
22. Service changes and availability
Nommad features may change, be suspended, or be discontinued. OneTap LLC does not guarantee uninterrupted, secure, or error-free availability, preservation of every feature, or compatibility with every device, browser, network, provider, or integration. We may perform maintenance and make reasonable operational changes.
23. Warranty disclaimer
To the maximum extent permitted by law, Nommad is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free availability. OneTap LLC does not guarantee vendor availability or acceptance, vendor status or location accuracy, menus, prices, food availability, dietary or allergen information, event outcomes, bookings, customer attendance, third-party provider availability, or uninterrupted service. Rights and warranties that cannot lawfully be excluded remain unaffected.
24. Limitation of liability
To the maximum extent permitted by law, OneTap LLC and its members, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, or service interruption arising from or related to Nommad. To the maximum extent permitted by law, their aggregate liability for all claims relating to Nommad will not exceed the greater of the amount the claimant paid to OneTap LLC for Nommad during the 12 months before the event giving rise to the claim or $100 if the claimant paid nothing. This section does not limit liability that cannot lawfully be limited or excluded.
25. Indemnification
To the extent permitted by law, users acting in a business, professional, Vendor, or organizational capacity agree to defend, indemnify, and hold harmless OneTap LLC and its members, officers, employees, contractors, and licensors from third-party claims, losses, liabilities, and reasonable costs arising from their submitted content, violation of these Terms, infringement of third-party rights, unlawful use, Vendor products or services, food or service operations, or violation of applicable law. This obligation does not apply to an ordinary consumer to the extent prohibited by applicable law.
26. Governing law and venue
These Terms are governed by the laws of the State of Maine, without regard to conflict-of-law rules. Subject to non-waivable rights and applicable law, disputes may be brought in a court of competent jurisdiction in Maine. Nothing in these Terms waives consumer or other rights that cannot lawfully be waived.
27. Changes to these Terms
OneTap LLC may update these Terms to reflect changes in Nommad, law, security, operations, or business practices. The current version will be posted with its effective date. Where required, we will provide additional notice. Continued use after an update becomes effective constitutes acceptance to the extent permitted by law.
